In a significant development within the Tamil Nadu police force, a senior IPS officer, D Magesh Kumar, has been reposted following the revocation of his suspension over allegations of sexual harassment. The case highlights the complexities involved in handling complaints against high-ranking officials, the role of internal committees, and the challenges in balancing justice and reputational concerns.
The Incident and Initial Action
The controversy began when a woman traffic constable filed a formal complaint against D Magesh Kumar, who at the time was serving as Joint Commissioner of Police (North), Greater Chennai Police. The allegations included both sexual and physical harassment, prompting immediate action from the Tamil Nadu Director General of Police (DGP), Shankar Jiwal. In February, Magesh Kumar was suspended pending an inquiry, a move that underscored the seriousness with which the police administration treated the complaint.
Investigation and Allegations of Extortion
As the case gained public attention, the officer’s wife, herself a former police sub-inspector, came forward with counter-allegations. She accused the complainant of attempting to extort Rs. 25 lakh from her husband and maintained that the harassment complaint was false. She also cited CCTV footage to support her claims. This development added a layer of complexity to the case, raising questions about the motives behind the initial complaint and the evidence presented by both sides.
Role of Internal Complaints Committee
To ensure a fair and impartial investigation, a Vishaka Committee—led by DGP Seema Agarwal—was formed. This committee, functioning as an Internal Complaints Committee (ICC), is mandated to probe allegations of sexual harassment within the workplace. After a thorough inquiry, the ICC recommended that no further action was required against Magesh Kumar, citing that a conciliation had been reached. Based on this recommendation, his suspension was revoked in April.
Re-posting and Current Status
Following the ICC’s decision, Magesh Kumar was placed in the Vacancy Reserve (VR) at the police chief’s office. In the latest reshuffle of police officers in Tamil Nadu, he has now been posted as DIG, Coastal Security Group, Chennai. This move replaces R Jayanthi, who has been reassigned as DIG, Technical Services, Chennai. Magesh Kumar’s reinstatement and new posting mark a significant turn in the case, reflecting the administration’s reliance on the findings of the internal committee.
