This was the reality for a 19-year-old engineering student from Pune, whose simple act of re-sharing a critical post about India’s Operation Sindoor landed her in a legal quagmire. Her story highlights the thin line between free expression and perceived threats to national security, raising urgent questions about justice and proportionality.
Swift Action, Harsh Consequences
After the student re-shared an Instagram post questioning the government’s narrative of the Pahalgam terror attack—and promptly deleted it within two hours—she also issued a public apology. Despite these corrective measures, the Pune Police registered an FIR against her under severe sections of the Bharatiya Nyaya Sanhita, accusing her of endangering national sovereignty and promoting enmity. The student’s world quickly unravelled as she was arrested, spent nearly 20 days in Yerwada jail, missed her crucial semester exams, and faced immediate expulsion from her college—all for a post she did not author.

The Bombay High Court stepped in, calling the case “absolutely shocking” and ordering her immediate release. The court suspended her expulsion, emphasising that her actions were at worst an “indiscretion by a young student who is still taking her education.” The judges admonished the college for its hasty decision and lack of due process, providing a much-needed corrective to the overzealous response.
